Registering a brand in India ensures legal protection against unauthorized use and builds credibility. The most common way to secure your brand is through Trademark Registration under the Trade Marks Act, 1999. Below is a step-by-step process to get your brand registered.

 

Step 1: Conduct a Trademark Search

Before applying, ensure your brand name/logo is unique to avoid rejection.

 

Looking to conduct a trademark search? Here’s how you can do it:

    1. Head over to the IP India website: https://ipindia.gov.in/trade-marks.htm.

    2. Click on “Public Search” found under the Trademark tab.

    3. Type in your desired brand name or logo and choose the appropriate class of goods or services.

    4. Take a look for any similar trademarks that might already be out there.

         If you don’t find any similar trademarks, you’re good to go ahead with your registration!
         If you do find a similar trademark, it’s best to tweak your brand name to steer clear of any conflicts.

 

Step 2: Identify the Trademark Class

Every brand belongs to a specific category of goods or services, which is defined by the Nice Classification system (covering 1-45 classes).

 

Here are a few examples of classes:

  •     Class 25 – Clothing, footwear, headgear
  •     Class 30 – Coffee, tea, sugar, rice
  •     Class 35 – Business management, advertising

Tip: If your business offers a variety of products or services, you might need to register multiple classes.

Step 3: Prepare Required Documents

To ensure your application process goes off without a hitch, make sure you gather all the necessary documents.

 

Here’s what you’ll need:

    1. Your personal details (Name, Address, Email, Mobile)
    2. Proof of business registration (like your GST Certificate, Incorporation Certificate, or MSME Certificate)
    3. Your brand name and logo (in JPEG format)
    4. A description of the goods or services you’re offering under the chosen class
    5. Power of Attorney (Form TM-48) if you’re applying through an agent or lawyer
    6. Identity and address proof (such as Aadhaar, PAN, or Passport for individuals)


 

Step 4: File the Trademark Application

You have two options for applying:

 

Option 1: Online Filing (Recommended)

    1. Visit IP India Website: https://tmrsearch.ipindia.gov.in/tmrpublicsearch/

    2. Register/Login as a new user.

    3. Fill out Form TM-A with brand details.

    4. Upload required documents and logo.

    5. Pay the applicable trademark fee online.

    6. Submit the application and get an Acknowledgment Number for tracking.

 

Option 2: Offline Filing

    1. Download Form TM-A from https://ipindia.gov.in.

    2. Fill out the form manually.

    3. Attach supporting documents.

    4. Submit the application at the nearest Trademark Registry Office (Mumbai, Delhi, Chennai, Kolkata, Ahmedabad).

Trademark Fees:

  •       ₹4,500 (For Individual/Startup/MSME)
  •       ₹9,000 (For Other Business Entities)

 

Step 5: Trademark Examination

    1. The Trademark Examiner reviews your application for legal compliance.

    2. If no issues, it moves to publication.

    3. If objections arise, the examiner issues an Examination Report.

    4. You must respond within 30 days.

        Timeframe: 2-3 months


 

Step 6: Trademark Publication

    1. If the application is approved, it is published in the Trademark Journal.

    2. The public can oppose the registration within 4 months.

    3. If No Opposition – Proceeds to final registration.
    4. If Opposed – Counter Statement is submitted within 60 days, and if needed Legal hearing is conducted, then a decision is made.

        Timeframe: 4 months


 

Step 7: Trademark Registration & Certificate Issuance

    1. If no objections or oppositions arise, the Trademark Office grants registration.

    2. You will receive a Trademark Registration Certificate.

    3. Your brand is now legally protected for 10 years, renewable indefinitely.

        Timeframe: 8-12 months


 

Step 8: Post-Registration Steps

    1. Use the ® Symbol – Once registered, replace ™ with ® to indicate legal protection.
    2. Monitor for Infringements – Regularly check for unauthorized use of your brand.
    3. Renew Your Trademark Every 10 Years – File Form TM-R before expiry.
